Welcome to Custom Patches ("we," "us," "our"). These Terms & Conditions ("Terms") govern your use of our website and any purchase you make from us. By placing an order or using this website, you agree to be bound by these Terms in full. If you do not agree, please do not use this website or place an order.

Custom Patches is an individually-owned and operated small business based in Goa, India, specializing in custom, made-to-order embroidery products. As we are not a registered company, all orders, communications, and legal matters are handled directly by the business owner.

2. Nature of Products

2.1 All products sold on this website are custom, made-to-order embroidery items, created specifically based on the specifications, designs, or instructions provided by the customer at the time of order.

2.2 Because each product is made specifically for you and is not a stock/ready-made item, standard return, refund, and exchange rights that apply to off-the-shelf products do not apply to orders placed through this website.

2.3 It is the customer's responsibility to review and confirm all order details — including design, size, color, spelling, placement, and any custom text — before payment is made. Once production begins, changes cannot be guaranteed.

3. Payments

3.1 We accept payments via UPI and Card, processed securely through Razorpay. Cash on Delivery (COD) is not available.

3.2 We accept any currency supported by Razorpay's payment gateway for international orders.

3.3 100% advance payment is required at the time of placing a custom order. Production will not begin until full payment has been received and confirmed.

3.4 By making payment, you confirm that you are authorized to use the selected payment method.

4. Shipping & Delivery

4.1 We offer both domestic (India) and international shipping. Serviceability depends on your location — some international destinations may not be serviceable, and we will inform you if this is the case at the time of order.

4.2 Standard delivery time is 15–20 days from the date of order confirmation and full payment, subject to order volume, customization complexity, and shipping location. This is an estimate and not a guaranteed delivery date.

4.3 Shipping costs are borne by us and included in your order, unless stated otherwise at checkout.

4.4 Once a shipment is handed over to our courier partner, we bear the risk of loss or damage in transit until it reaches you. See Section 5 for related refund terms.

4.5 Delivery timelines may be affected by factors outside our control (customs delays, courier disruptions, natural events, etc.). We will make reasonable efforts to keep you informed of significant delays.

5. Returns, Refunds & Exchanges

5.1 As all products are custom-made to order, we do not accept returns, exchanges, or cancellations once an order has been confirmed and payment received, except as described below.

5.2 Refunds are only issued if:

- Your order is confirmed lost in transit by the courier partner and does not reach you, or

- We are unable to fulfill/ship your order for reasons on our end.

5.3 No refunds, returns, or exchanges will be provided for:

- Change of mind after order confirmation

- Errors in customization details submitted by the customer (spelling, size, design choice, etc.)

- Minor variations in color, texture, or finish that are natural to handmade/embroidered products

- Delays caused by incorrect address details provided by the customer

5.4 If you believe your order qualifies for a refund under Section 5.2, please contact us within 7 days of the expected delivery date with your order details.

6. Intellectual Property

6.1 All designs, artwork, patterns, product photography, logos, and content on this website are the intellectual property of Custom Patches, unless explicitly created for and owned by a customer under a custom commission agreement.

6.2 You may not copy, reproduce, distribute, resell, or use our designs or artwork — in whole or in part — for commercial or personal manufacturing purposes without our prior written consent.

6.3 If you submit your own design, image, or artwork for a custom order, you confirm that you either own the rights to it or have permission to use it, and you agree to indemnify us against any third-party claims arising from its use. We reserve the right to refuse any order that appears to infringe on third-party intellectual property rights.

6.4 Unauthorized use of our original designs may result in legal action.

7. Website Use & Conduct

7.1 You agree to use this website only for lawful purposes. You must not:

- Use the website in any way that could damage, disable, or impair its functioning

- Attempt to gain unauthorized access to any part of the website, our systems, or related networks

- Scrape, copy, or extract website content or data using automated tools

- Place fraudulent orders or use stolen/unauthorized payment methods

- Impersonate any person or misrepresent your affiliation with any person or entity

7.2 We reserve the right to refuse service, cancel orders, or restrict access to the website for anyone found violating these Terms.

8. Limitation of Liability

8.1 To the fullest extent permitted by law, Custom Patches shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of this website or purchase of our products.

8.2 Our total liability for any claim arising from an order shall not exceed the amount paid by you for that specific order.

8.3 We are not responsible for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, courier/postal delays, customs holds, or technical failures.

8.4 Nothing in these Terms limits or excludes any liability that cannot legally be limited or excluded under applicable Indian law.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or your use of this website shall be subject to the exclusive jurisdiction of the courts located in Goa, India.

10. Changes to These Terms

We reserve the right to update, modify, or replace these Terms at any time, without prior notice, at our sole discretion. Changes will be effective immediately upon posting to this page. Your continued use of the website following any changes constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
